Terms and Conditions
These terms govern business access to and use of MarkAI.

1. About MarkAI
MarkAI is operated by DevNack LTD, registered in Scotland under company number SC737354, with its registered office at 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN, UK. Contact us at hello@markai.io.
2. Agreement and business use
By creating an account or using MarkAI, you agree to these terms and acknowledge our Privacy Policy. MarkAI is offered only for business purposes. You confirm that you are at least 18 years old and, if acting for an organisation, have authority to bind that organisation. References to “you” include that organisation.
3. The service
MarkAI monitors supported public community sources using project information and active keywords, organises matching content, uses automated systems to assess relevance, and may send grouped alerts and daily digests. MarkAI is a discovery and decision-support service. It does not post, reply, or enter into transactions on your behalf.
4. Accounts and verification
You must provide accurate information, verify your email address, protect your credentials, and promptly notify us of suspected unauthorised access. You are responsible for activity performed through your account and for keeping business contact and billing details current.
5. Acceptable use
You must not use MarkAI to break the law, infringe rights, harass others, distribute spam, evade platform restrictions, collect sensitive personal information, probe or disrupt our systems, resell unauthorised access, or submit content you do not have the right to process. You remain responsible for every response you choose to publish and for complying with each third-party platform’s rules.
6. Your content and instructions
You retain ownership of information you submit. You grant DevNack LTD a limited, non-exclusive licence to host, copy, transmit, and process that information only as needed to provide, secure, support, and improve MarkAI. You confirm that your instructions and submitted information are lawful and do not violate another person’s rights.
7. AI and third-party platforms
Automated scores, explanations, and generated keywords may be inaccurate, incomplete, or unsuitable. You must review results before relying on them. Community platforms and optional integrations, including Slack, are operated by third parties and may change, restrict access, remove content, or become unavailable without notice. Their terms apply independently to your use of their services. When you connect Slack, you authorise MarkAI to deliver alerts containing project and public-conversation information to the workspace and channel you select.
8. Trials, active keywords, and pricing
Unless a different written offer applies, MarkAI offers a fourteen-day free trial without requiring a payment card. The trial starts when you finish onboarding and includes up to 30 active monitoring keywords, 1,400 AI-analyzed conversations during the trial, and a daily burst of 100 AI analyses.
Current monthly plans are Starter at USD $19 for 15 active keywords and 4,500 AI-analyzed conversations, Alpha at USD $49 for 50 active keywords and 18,000 AI-analyzed conversations, and Growth at USD $99 for 150 active keywords and 60,000 AI-analyzed conversations. Their respective daily AI-analysis burst limits are 300, 1,200, and 4,000. These allowances are shared across all projects in the account. An active keyword includes enabled product, problem, solution, pain-point, brand, and competitor terms. Disabled keywords do not use the keyword allowance.
An initial project scan analyzes no more than 100 conversations with AI. When an account reaches a daily or billing-period AI-analysis allowance, MarkAI may defer recent conversations until capacity becomes available and may skip older deferred conversations. Current pricing and allowances will be displayed before purchase. Directly managed subscriptions may use custom written allowances. We may change future pricing by giving reasonable notice; changes will apply from a subsequent billing period.
9. Payment, renewal, cancellation, and refunds
Paid subscriptions may be processed by Stripe or arranged directly with DevNack LTD by invoice, bank transfer, or another agreed payment method. Stripe subscriptions renew for the billing period shown at checkout until cancelled. Directly arranged subscriptions follow the written payment period and active-keyword allowance agreed with you. You authorise applicable recurring charges and are responsible for taxes unless stated otherwise. You may cancel before the next renewal, and access ordinarily continues until the end of the paid period.
Payments are non-refundable, including for unused time, except where required by applicable law, where we expressly agree otherwise, or where a confirmed billing error occurred. Cancellation prevents future renewal but does not retrospectively reverse charges already due.
10. Intellectual property
DevNack LTD and its licensors retain all rights in MarkAI, including its software, branding, design, documentation, and service-generated systems. These terms grant you a limited, revocable, non-transferable right to use MarkAI internally for your business during your account term.
11. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security incidents, provider outages, API changes, rate limits, or events outside our reasonable control may delay or prevent monitoring. We may modify features where reasonably necessary while seeking not to materially reduce paid functionality without notice.
12. No guarantee of results
MarkAI does not guarantee that it will find every relevant conversation, that a result will remain available, or that using the service will produce replies, leads, revenue, customers, or any particular business outcome. You are responsible for deciding whether and how to engage with a conversation.
13. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that, DevNack LTD is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, anticipated savings, or data.
To the maximum extent permitted by law, DevNack LTD’s total aggregate liability arising from MarkAI in any 12-month period is limited to the fees you paid for MarkAI during that period. You should maintain appropriate backups and independently review information used for business decisions.
14. Suspension and termination
We may suspend or terminate access where reasonably necessary for security, non-payment, unlawful use, material breach, risk to another user or provider, or compliance with law. You may stop using MarkAI and request account deletion. Provisions intended to survive termination, including payment, intellectual-property, liability, and dispute terms, will continue.
15. Privacy
Our Privacy Policy explains how we handle personal information. You are responsible for determining whether your own use of MarkAI requires notices, lawful bases, contracts, or other compliance measures.
16. Changes to these terms
We may update these terms to reflect service, provider, security, or legal changes. We will publish the revised date and give reasonable notice of material changes. Continuing to use MarkAI after a change takes effect constitutes acceptance of the updated terms.
17. General terms
If any provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not assign these terms without our written consent; we may assign them as part of a reorganisation, financing, or transfer of the service. These terms, the Privacy Policy, and any agreed order details form the entire agreement concerning MarkAI.
18. Governing law and courts
These terms and any non-contractual dispute are governed by Scots law. The courts of Scotland have exclusive jurisdiction, except where applicable law requires otherwise.
